Article 1 (Purpose)

These Terms govern the conditions and procedures for using the experimentSpace service ("Service") provided by hamsterlab ("Company"), and define the rights, obligations, and responsibilities of both the Company and users.

Article 2 (Definitions)

1. "Service" means the HTML webpage hosting and deployment platform provided by the Company.
2. "User" means any individual or entity using the Service in accordance with these Terms.
3. "Content" means all HTML files, images, text, and other materials uploaded, hosted, or distributed through the Service.
4. "Subscription" means the paid monthly plan for using the Service.

Article 3 (Operator Information)

Article 4 (Effect and Modification of Terms)

1. These Terms become effective when posted on the Service or otherwise announced.
2. The Company may modify these Terms within the scope permitted by applicable laws.
3. Changes will be notified at least 30 days in advance via email and in-service notice. Unfavorable changes require 60 days advance notice.
4. Users who disagree with modified Terms may terminate their use before the effective date.

Article 5 (Account Registration)

1. Users must follow the Company's registration procedures to use the Service.
2. Users must provide accurate information and update it promptly when changes occur.
3. Users are responsible for maintaining the security of their account credentials and may not share or transfer them to third parties.
4. Users must immediately notify the Company of any unauthorized use or security breach.

Article 6 (Service Description)

The Company provides the following services:

• HTML file upload and web hosting
• Custom domain connection support
• HTTPS secure connection
• Form data collection and analytics
• Content management via dashboard

Specific features and limitations may vary by subscription plan.

Article 7 (Payment and Subscription)

1. The Service is provided on a monthly subscription basis.
2. Subscriptions are valid for one month from the payment date and automatically renew unless cancelled.
3. Payments are processed through a third-party Merchant of Record. Payment inquiries may need to be directed to the payment service.
4. The Company may change fees with at least 30 days advance notice.

Article 8 (Refund Policy)

1. Upon cancellation, users may continue using the Service until the end of the current billing period.
2. Refunds are processed according to the Merchant of Record's policies.
3. The Company will compensate for periods when service was unavailable due to the Company's fault.

Article 9 (User Obligations)

Users must not:

1. Use others' information fraudulently or register false information
2. Host or distribute illegal content
3. Infringe on intellectual property, privacy, or other rights of others
4. Distribute malware, phishing pages, spam, or other harmful content
5. Interfere with normal service operations or gain unauthorized system access
6. Resell the Service or use it commercially without authorization
7. Abuse infrastructure through DDoS attacks, cryptocurrency mining, etc.

Article 10 (Prohibited Content)

The following content may not be hosted or distributed through the Service:

1. Child sexual abuse material or content harmful to minors
2. Content related to illegal gambling, drug trafficking, or other crimes
3. Hate speech, discrimination, or content inciting violence
4. Copyright-infringing materials or illegal copies
5. Phishing, fraud, or deceptive webpages
6. Malware, virus, or ransomware distribution pages
7. Any other content prohibited by applicable laws

Article 11 (Content Rights)

1. Users retain intellectual property rights to their uploaded content.
2. Users grant the Company a non-exclusive license to store, reproduce, transmit, and display content for service provision purposes.
3. The Company will not use user content for purposes other than providing the Service.
4. Users warrant that they have lawful rights to all uploaded content.

Article 12 (Service Intellectual Property)

1. Intellectual property rights to the Service, software, technology, design, and trademarks belong to the Company.
2. Users may not reverse engineer, decompile, copy, or create derivative works from the Service.

Article 13 (Copyright Infringement Reports)

DMCA (US)

The Company complies with the US Digital Millennium Copyright Act (DMCA). Copyright infringement reports should include:

• Copyright owner identification and contact information
• Identification of the infringed work
• URL of infringing content
• Sworn statement

Upon receiving valid DMCA notices, the Company will remove the content and notify the user.

EU DSA

For EU users, we operate a Notice-and-Action procedure under the EU Digital Services Act (DSA).

Article 14 (Service Provision and Changes)

1. The Company aims to provide the Service 24/7, year-round.
2. Scheduled maintenance will be announced at least 48 hours in advance.
3. The Company may add, modify, or discontinue features with 30 days notice for significant changes.

Article 15 (Privacy)

1. The Company collects, uses, and protects user personal information according to its Privacy Policy.
2. The Privacy Policy is posted separately on the Service website.

Article 16 (Disclaimers)

1. The Company is not responsible for the legality or accuracy of user-hosted content.
2. The Company does not intervene in disputes between users or between users and third parties.
3. However, the Company is liable for damages caused by its willful misconduct or gross negligence.

Article 17 (Limitation of Liability)

1. To the extent permitted by applicable law, the Company's total liability is limited to the amount paid in the 12 months preceding the incident.
2. The following are excluded from this limitation:
   • Willful misconduct or gross negligence by the Company
   • Damages from personal data breaches
   • Damages where limitation is prohibited by law

Article 18 (Indemnification)

1. Users indemnify the Company against all claims arising from Terms violations, illegal content, or third-party rights infringement.
2. The Company will defend users against third-party claims of intellectual property infringement by the Service itself.

Article 19 (Termination)

1. Users may terminate at any time through account settings or customer support.
2. The Company may take action for Terms violations:
   • Minor violations: 48-hour cure period before termination
   • Serious violations: Immediate suspension and termination
3. Content is retained for 30 days after termination, then deleted.
4. Indemnification, limitation of liability, and governing law provisions survive termination.

Article 20 (Governing Law and Dispute Resolution)

1. These Terms are governed by the laws of the Republic of Korea.
2. Disputes are resolved in the following order:
   • Step 1: Consultation through customer support
   • Step 2: Mediation (Korea Internet & Security Agency, etc.)
   • Step 3: Competent court
3. Consumer users' legal rights are not limited by these Terms.

Article 21 (General Provisions)

1. Severability: If any provision is invalid, the remaining provisions remain effective.
2. Entire Agreement: These Terms constitute the complete agreement regarding Service use.
3. No Waiver: Delay in exercising rights does not constitute waiver.
4. Non-Assignment: Users may not assign rights or obligations without Company consent.

These Terms become effective on January 15, 2026.
